MUMBAI: Rail Corporation Ltd, a joint venture between the state and centre, which is building the 3.5 km route from to Seepz via sought that a stay on tunnelling work under two heritage Atash Behrams be vacated or the matter be heard on an urgent day-to-day basis by the Bombay high court.

Metro counsel S G Aney sought a peremptory urgent hearing either by the existing bench headed by the acting Chief Justice Naresh Patil or before any other specially assigned bench. He said keeping the (TBM) idle underground is likely to cause damage. The HC which is hearing a petition by a few Parsis has stayed till September 18, the next date of hearing, tunnelling work under two of only eight highest grade fires in India. Navroz Seervai counsel for the Parsis said he would file a reply to oppose the MMRCL plea for vacating the stay but agreed that the matter could be heard earlier.

The plea for relief by MMRCL follows an order of last Friday, where the HC bench had permitted it and its contractors L & T -STEC JV Mumbai, to carry out construction and ancillary activities at night too, between 10 pm and 6 am, in Cuffe Parade with care taken to follow NEERI recommendations on noise and with a grievance mechanism in place.
